On June 5, 1943,' the United States attorney for the Southern District of New, York filed a libel against 10 boxes of. butter at New York, N. Y., alleging that the article had been shipped in interstate commerce on or about May. 19,1943, by the Slay ton. Creamery from Slay ton, Minn.; and charging that it was adulterated in that it contained less than 80 percent by weight of milk fat. The article was labeled in part: "Butter S & W Waldbaum Inc. .*.*•* Distributors New York NY." . On June 18, 1943, the Slay ton Creamery Co; having appeared as claimant and having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for reworking under the supervision of the Food and Drug Administration.
