My statement is based on the Fall 1966 testing of pupils in grades l,6, 9 and 11-- using STEP Reading and Mathematics and SCAT. Comparable data arw not available since the testing progngmhave changed over the years, The fact is that the District achievement has not been adequately studied and test data have been badly handled and misused, As for the second query, except for an indirect contact in June 1566 when Hobsen tried to get an injunction against the Board having the study done, I have had absolutely no contact with the case, I was subpoened to testify on the matter of granting the injunction but Judge Wright dismissed the subpoena when I could not be present 2) hours after it was served since I had other commitments here in New York City. I was not asked to testify by either the plaintiff or the defendent; the Judge asked for nothing from me. Much of what Judge Wright includes in his decision amgood—ieade-of- material submitted by Hobsen'ts lawyer as "Findings of Fact and Conclusions of Law", Much of thia material is taken verbatim.
