Attached is a copy of the Berkeley, California biohazards ordinance that was adopted by the City Council in October, 1977.
In effect, this ordinance requires that potentially hazardous biological research or application of such research may not be commenced without the permit issued by the City Council.  No permit may be issued for more than one year however, they may be issued for a shorter period.  The applicant must pay a fee of $100 for each permit.  In order to be eligible for approval, an applicant must comply with the NIH Guidelines, any pertinent federal legislation plus any additional requirements promulgated by the Berkeley Department of Health.  The only technical expertise mandated in the ordinance is consultation with the University of California biohazards committee.
In sum, this is a second tier of regulation on top of all federal regs.  A third tier could appear if the state promulgates regulations.
