Whereas, to prepare and dispense Drugs and Medicines for the use of the sick, requires knowledge and skill of a peculiar kind, an ignorance of which is productive of numerous evils and abuses, and is pregnant with serious consequences to health and life; it is manifestly the duty of all engaged in the profession of Pharmacy to become proficient in its principles and in the collateral branches of science. In order, therefore, to provide the means of a sys- tematic education,—to regulate the instruction of ap- prentices,—to promote a spirit of pharmaceutical in- vestigation, and to diffuse information among the members of the profession,—to discountenance the sale of spurious, adulterated, and inferior articles,— to regulate the business, as far as practicable, and consistent with our social institutions,—to cherish habits of friendly intercourse, and in general to ad- vance the character and interest of the profession,— We, the undersigned, Druggists and Apothecaries, agree to associate together under the following Con- stitution, which we adopt in principle, and to which we will adhere in practice. 4 CONSTITUTION. ARTICLE I. NAME AND FOUNDATION. The Association shall be known as the Massachu- setts College of Pharmacy, and shall consist of its present members, and those who may be elected hereafter in conformity to its By-laws. ARTICLE II. OFFICERS AND THEIR POWERS. The officers of the College shall be a President, two Vice Presidents, Recording Secretary, Corre- sponding Secretary, Treasurer, and Auditor. There shall also be elected, at the same time, eight Trus- tees, who, with the other officers of the College, shall serve one year, or until others are chosen to fill their place. The officers shall be voted for, either by printed or written ballots, at the annual meeting of the College, which shall be held on the first Monday in March. The officers of the College shall be ex- officio members of the Board of Trustees, and the said Board, of which not less than five shall consti- tute a quorum, shall conduct the ordinary affairs of the College. They may elect their own Chairman and Secretary, who shall keep a record of their pro- 5 ceedings. They may make such rules and regula- tions, and do such other things necessary for the sup- port and government of the College of Pharmacy, as they may deem fit and proper, and perform such du- ties as are or may be from time lo time committed to them by the said College; their acts, however, to be submitted to the College for revision, at each stated meeting. ARTICLE III. TRUSTEES. The Board of Trustees shall have power to issue certificates of membership, to adopt rules and regu- lations in the examination of candidates, and the granting of diplomas to those who shall have attended two courses of lectures of the College, and have studied four years with one or more respectable drug- gist or apothecary, or shall have undergone a satis- factory examination by the Trustees and Professors of the College. ARTICLE IV. ELECTION OF OFFICERS. If the annual election for officers of the College and members of the Board of Trustees, shall not be held on the day before mentioned, the said Corpora- tion shall not be thereby dissolved, but the oin ers and Trustees shall continue in office until a new election. \* 6 BY-LAWS OF THE COLLEGE. ARTICLE I. OFFICERS AND THEIR DUTIES. Sect. 1. It shall be the duty of the President, and in his absence one of the Vice Presidents, in their order, and in their absence, of a Chairman to be appointed pro tempore, to preside at all meetings of the College, and in case of an equal division, to have a casting vote. It shall also be the duty of the President to sign the diplomas, and certificates of membership of the College. Sect. 2. It shall be the duty of the Treasurer to collect anil take charge of all moneys belonging to the College, and to render an account of ihe same, embracing the items of receipts and expenditures for the preceding year, at the staled meeting in March. and also as often as he maybe required by the Board of Trustees. He shall give bond and security for the faithful performance of his trust, and shall pay no moneys except on the order of the President, or Chairman of the Board of Trustees, countersigned by the Secretary. Sect. 3. The Recording Secretary shall keep ac- curate minutes of the transactions of the College,— shall furnish to Committees a minute of their ap- pointment, and give at least two days notice to the members of the time and place for meeting, He shall fill up the blank certificates of membership, and keep an accurate roll of the members. 7 Sect. 4. The Corresponding Secretary shall con- duct the correspondence of the College with such foreign members and scientific societies, as it may from time to time direct. It shall be his duty lo reply to all communications addressed to or regarding the College. He shall first submit aH his proceedings to the President for his approval, and their record shall be read at each stated meeting of the College. He shall keep a separate book for the record of his proceedings. Sect. 5. The Auditor shall examine the books and vouchers of the Treasurer, and shall at each stated meeting, or oftener if required, report upon the same to the College. ARTICLE II. STATED meetings. Sect. 1. The stated meetings of the College shall be held on the first Monday of March and Sep- tember, commencing at 7 o'clock, P. M. Sect. 2. Ten members shall form a quorum. If a quorum shall not be in attendance within one hour from the time appointed for the meeting, the mem- bers present shall be authorized to adjourn the meet- ing to another day. Sect. 3. The business of these meetings shall be conducted in the following order:— 1st. The roll of members to be called by the Re- cording Secretary, and absentees noted. 2d. Minutes of the preceding meeling shall be read, corrected if necessary, and adopted. 2* 8 3d. Reports of Committees (which shall always be in writing) shall be received, and all unfinished business acted on. 4th. The minutes of the Board of Trustees since the last stated meeting of the College shall be read, and business arising therefrom attended to. 5th. Persons proposed for honorary membership shall be balloted for. 6th. Incidental business shall be taken up. Sect. 4. No motion shall be received unless seconded, and shall be in writing, if so required by any member; and when any question is before the meeting, no motion shall be received unless to amend, commit or postpone, or to adjourn ; and the latter shall be decided without debate, except such adjournment is to some specified time, when it shall be considered debateable. Sect. 5. All members when speaking shall rise> and address the Chair, and no member shall speak upon any question more than twice, unless by per- mission of the presiding officer. Sect. 6. All questions of order shall be decided by the Chair, unless an appeal to the meeting be made and seconded, when it shall be decided by the meeting without debate. Sect. 7. By order of the President, or in his ab- sence, of the officer upon whom his duties may de- volve, or at the request in writing of seven members specifying the objects in view, the Secretary shall call a special meeting of the College; and at such 9 meeting no other business shall be taken up but that for which it was specially called. Sect. 8. All meetings of the College shall be called to order as soon after the hour of meeting as there shall be a quorum present, after which no member shall leave the room without permission from the presiding officer. ARTICLE III. QUALIFICATION OF MEMBERS. Sect. 1. Any adult person of correct moral de- portment, and who shall have been actively engaged as a wholesale Druggist or a dispensing Apothecary, for the term of four years, either as principal or clerk, may be admitted as a member of this College in the manner hereinafter set forth. In order to his admis- sion, he must be proposed, in writing, by two mem- bers at a stated meeting of the Board of Trustees, and be balloted for at the succeeding meeting of the same. Three fourths of the votes shall be necessary for his admission. He must pay an admission fee of five dollars, and sign the by-laws of the College, and shall pay an annual contribution of five dollars as long as he shall continue a member. Every member/ who is not in arrears, and who has passed an exami- nation as provided for in Article IV., shall be furnished with a certificate of membership, upon the stipulation in writing, by the holder, that it shall be reclaimed by the College when the membership of the individual 6hall cease from any cause whatever; and if called 3* 10 for by a vote of two thirds of a meeting of the Board of Trustees, and refused, a statement of the circum- stances, with a copy of his agreement, shall be pub- lished at the discretion of the Board. Sect. 2. No member of this College shall taks an apprentice for a shorter term than four years, and it shall be rendered obligatory on such apprentice, to attend two full courses of the lectures of the College during his term. Sect. 3. No member who is in arrears six months for his annual contribution, shall be entitled to vote. The annual contribution shall be payable at the stated meeting of the College in March, and shall be col- lected immediately after. If any member elect do not pay his initiation fee and sign the by-laws within three months from the date of his election, it shall be considered void; and if he apply again for admis- sion, he must be balloted for anew. And upon the representation of the Treasurer to the Board of Trus- tees, at a stated meeting, any member, who, being in the City of Boston, shall have neglected to pay his yearly dues, or who shall refuse to pay the same for eighteen months, shall be specially notified to attend the next stated meeting of the College to show cause for such neglect; and in case of failure or inability to show, what shall appear to the majority of the meeting, a sufficient excuse, his name shall be stricken from the roll. Sect. 4. The College may elect, at their stated meetings, on the recommendation of the Board of Trustees, as honorary members, Druggists and 11 Apothecaries who have retired from business; and Chemists, and men of science, either in this or in any other country, whose labors have added to the general stock of scientific knowledge. From such members, no contribution shall be required. They shall have the privilege of the use of the library, and of attending the lectures and meetings of the College, but they shall not be entitled to vote. Sect. 5. Complaints may be preferred against any member of the College lo the Board of Trustees, for misconduct in his business, either by the adul- teration of articles or otherwise. If the Trustees are satisfied that such complaints are well founded, they shall appoint a sub-committee to remonstrate with the individual ; and if he shall refuse or neglect to remedy the evil complained of, the Trustees may report the case to a meeting of the College, to be called by the President at their request, giving ihe offending member due notice thereof, and at such meeting he may be expelled by a vote of three fourths of the members present. ARTICLE IV. DIPLOMAS. Sect. 1. Each candidate for ihe diploma, who has complied with the requisitions of the Constitution of the College, shall, during the last week of the leclures, or three weeks previous to the meeting in March, give in his name to the Secretary, with a dissertation or thesis on some article of the materia medica. or an analysis of some chemical substance conducted 12 by himself, which is to be laid, by the Secretary, be- fore the Board of Trustees. If the thesis be satis- factory to the Board, a day shall be appointed for the examination. Each candidate shall be examined separately by the professors and Board of Trustees. A vote of three fourths of the Trustees present shall be necessary to his success. If he pass satisfactorily, his diploma shall be presented by the President, or some member selected for that purpose, at the next stated meeting of the College, or at an adjournment thereof, when his thesis shall be read, provided, in all cases, that the candidate shall have attained the age of twenty-one years, and shall have paid in to the Treasurer of the College, five dollars, as the graduation fee. Any person complying with the requisitions of the Constitution and By-laws of the College, aud who shall be so situated as to have been unable to avail himself of attendance upon the lectures of this, or any other regularly constituted College of Pharmacy, may receive a certificate of membership from this College by complying with the following conditions. Each applicant for a cer" tificate of membership shall be examined by a Com- mittee appointed by the Trustees for that purpose, and in the same manner as in cases of application for diploma, except that in the examination for wholesale Druggists the presence of the professors may be dispensed with ; and each applicant shall have the privilege of being examined as a wholesale Druggist, or as a dispensing Apothecary or Chemist, and the examination shall be conducted in accord- 13 ance therewith. If as a wholesale Druggist, he shall be examined as to the origin, commercial his- tory, qualities, and general appearance of any crude drugs or medicines, and upon any other point in re- lation to preparing the same ready for sale, and dis- tribution to the retailer. If as a dispensing Apothe- cary, he shall be examined as to the quality and general appearance of drugs as offered for sale, the different modes of ascertaining their quality and purity, the mode of making ihe different chemical preparations used in dispensing, the examination of their purity and strength, the method of dispensing them, and all other points relating to the business of an Apothecary. Such examination proving satisfac- tory to the Committee, and upon a vote of three fourths of the Trustees present, he shall be entitled to receive a certificate of membership, which certifi- cate shall set forth clearly and distinctly the nature of the examination, whether as a wholesale Druggist, or a dispensing Apothecary. Sect. 2. A regular apprenticeship with a member of any other legally constituted College of Pharmacy, and the attendance of one full course of its lectures, shall be sufficient to entitle a student, who may sub- sequently attend one full course of the lectures in this College, and who shall pass satisfactorily the required examination, to receive the diploma of graduate of the Massachusetts College of Pharmacy. Sect. 3. The College shall be located in the City of Boston. 14 ARTICLE V. ALTERATION of by-laws. Sect. 1. No alteration shall be made in these, or the by-laws for the Trustees, unless proposed to the College at one stated meeting, considered at the next, and adopted by two thirds of the members present. Sect. 2. We agree to abide by the Constitution and By-laws of the Massachusetts College of Phar- macy. BY-LAWS OE THE BOARD OF TRUSTEES. Sect. 1. The Board of Trustees shall meet statedly on the first Thursday of every month, at 7 o'clock, P. M., except during ihe summer months, when the hour of meeting shall be 8 o'clock. The Board shall have the privilege of holding their stated meetings at 4 o'clock in the afternoon, if they prefer, the hour not to be changed at any time for a le^s period than three months. The meetings of ihe Board during the summer months may be dispensed with at its discretion. Sect. 2. The officers of the College shall be, ex- officio, Ihose of the Board of Tiustees. Five mem- bers shall form a quorum. If a quorum shall not be in attendance within one hour from the time appointed for the meeting, the members present shall be au- thorized to adjourn the meeting to another day. Sect. 3. The Board of Trustees shall have full 15 power to conduct the affairs of the College, both those appertaining to its finances, and also to the general objects for which it was founded. The whole of the proceedings shall be regularly entered on the minutes, together with the ayes and noes (if required by any member) upon all disputed questions, for the inspec- tion of the College at its stated meetings. Sect. 4. All the proceedings of the Boaid of Trustees at its meetings shall be conducted in the same order, and as closely in conformity with the regulations for those of the College, as circumstances will permit. Sect. 5. In case of the death or removal from the city of a Trustee, the College shall, at its next stated meeting, fill the vacancy thus occasioned. If a Trustee neglect to attend three successive meetings of the Board, without assigning a sufficient reason therefor, the Trustees may report his name to the next stated meeting of the College, when his place may be declared vacant, and supplied by the election of another member. Sect. 6. The Board shall appoint, as often as may be necessary, suitable persons as professors of such branches of science as may be useful in the instruc- tion of Apothecaries. Sect. 7. It shall also fix the price of tickets, and the remuneration which it may be necessary to allow the professors; the number of lectures, and the place and time at which they shall be given, and all other matters in any manner connected therewith. Sect. 8. A Committee of three persons shall be 16 annually appointed by the Board, to be denominated the u Library Committee," whose duty it shall be to procure, under the direction of the Trustees, such books and specimens of materia medica, &c.,as may be found necessary. It shall also be their duty, in conjunction with the professors, to publish in pamph- let form, under the title of the u Journal of the Mas- sachusetts College of Pharmacy," such essays and extracts from books of science as may be approved by the Board of Trustees. Sect. 10. The Board shall annually appoint a Standing Committee of " Inspection," to consist of three persons, whose duty it shall be to examine all drugs and medicines that maybe submitted to them, and to report to the Board such unmerchantable or 6purious articles as may come within their knowledge. Sect. 11. There shall also be annually appointed by the Board, a Standing Committee of (: Reference," who shall decide on all cases of dispute that may arise in the transaction of business between members of this College, which may be referred to them. It 6hall be the duty of this Commit;ee to receive all complaints, which may be preferred against any member, for misconduct, or mal-practice in his busi- ness, and to report the same, with such information as they may possess, to the next meeting of the Board. Sect. 12. These Committees shall be nominated by the Chairman of the Board of Trustees, at the next stated meeting of the Board, after the annual meet- ing in March. 17 PHARMACEUTICAL MEETINGS. There shall be meetings of the College on the first Monday of every month, which shall be specially devoted to scientific purposes, and to be conducted in the following manner:— 1st. After the meeting is organized, the minutes of the preceding meeting are to be read, corrected if necessary, and adopted. 2d. Donations received, either in moneys, books, or specimens for the cabinet. 3d. Strangers introduced. 4th. Reports of Committees; 5th. Written communications. 6th. Oral communications, miscellaneous business, and conversation. Any essay read at these meetings, and intended for publication in the Journal, shall be given to the Committee, to whom such matters belong. The Secretary shall keep a separate book for the record of these meetings, which shall be denomi- nated " Pharmaceutical Meetings of the Massachu- setts College of Pharmacy." The hour for these meetings shall be as follows : from October to April, at 7 o'clock; and from April to October, at 8 o'clock, P.M.
