ALLEGED SHIPMENT : On or about July 10 and August 8, 1952, by Archibald & Kendall, Inc., from New York, N. Y. PRODUCT: 47 5-pound tins of Pepperette at Detroit, Mich. Examination dis- closed that the product consisted of approximately 50 percent black pepper, cornmeal, soya meal, and wheat. LABEL IN PART: "Pepperette Pure Black Pepper—Cereal Extended." NATURE OF CHARGE: Adulteration, Section 402 (b) (4), cornmeal, soya meal, and wheat had been added to the article and mixed and packed with it so as to increase its bulk or weight and reduce its quality or strength. Misbranding, Section 403 (a), the label designation "Pepperette Pure Black Pepper—Cereal Extended"' was false and misleading. DISPOSITION : December 10, 1952. Default decree of condemnation. The court ordered that the product be delivered to a Federal institution.
