LIBEL FILED: On or about August 24, 1944, Southern District of Illinois. ALLEGED SHIPMENT: On or about August 15, 1944, by the Aro Creamery Co., from St. Louis, Mo. PRODUCT: 3 cases, each containing 30 pounds, of butter at Alton, Ill. Analysis of a sample showed that the product contained mold. LABEL IN PART: (Carton) "Luer's Creamery Butter." VIOLATION CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy or decomposed animal substance. DISPOSITION: September 6, 1944. No claimant having appeared, judgment of condemnation was entered and the product was ordered sold to the highest bidder, to be denatured for use as an inedible fat.
