Y., alleging that the article had been shipped in interstate com- merce on or about February 16, 1943, by the Independent Grocers Alliance from Oakland,' Califi; and charging'that it was adulterated in that it contained decom- posed tomato material. The article was labeled inŠ part: (Cans) "H M Hi Man Fancy Tomato Puree * * * Louis T. Snow & Co. Distributors Sa;i Francisco, Calif." ' ; On June4\ 1943, no claimant having appeared, judgment of condemnation was entered and the product was ordered delivered to a public or private charitable institution.
