19801. Adulteration of prunes.    U. S. v. John Clare Tracy (J. C. Tracy A

This action was based on the interstate shipment of quantities of prunes, 
samples of which were found to be insect-infested, decomposed, bin-spoiled, and 
excessively lye-cut.
On May 18, 1932, the United States attorney for the District of Oregon, 
acting upon a report by the Secretary of Agriculture, filed in the District 
Court of the United States for the district aforesaid an information against 
John Clare Tracy, trading as J. C. Tracy & Co., Dallas, Oreg., alleging shipment 
by said defendant in violation of the food and drugs act, between the dates of 
January 26, 1931, and February 23, 1931, from the State of Oregon into the 
State of New York, of quantities of prunes that were adulterated. The article 
was labeled in part: " Oregon Prunes Web Foot Brand * * * Packed by 
J. C. Tracy & Co., Dallas, Oregon."
It was alleged in the information that the article was adulterated in that 
it consisted in whole and in part of a filthy and decomposed and putrid vege- 
table substance.
On May 18, 1932, the defendant entered a plea of guilty to the information, 
and the court imposed a fine of $250.
